Welcome to Swaddl. These Terms of Service ("Terms") govern your use of the Swaddl platform, website, and related services (the "Service"). By creating an account or using the Service, you agree to these Terms.
1. Who we are
Swaddl is a practice management platform that connects families seeking postpartum doula care with certified, vetted doulas. We facilitate matching, contracts, payments, and benefit billing between families and independent doulas. Swaddl is not a medical provider and does not provide medical care or advice.
2. Eligibility
You must be at least 18 years old to create an account. Doulas must hold valid certification from a recognized training organization (DONA, CAPPA, or equivalent) and meet our credentialing standards.
3. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us immediately at mia@swaddl.co if you suspect unauthorized access.
You agree to provide accurate, current, and complete information during registration and to update it as necessary.
4. Nature of the Service
Swaddl operates as a professional infrastructure platform. We facilitate the relationship between families and independent doulas — we do not employ doulas and we are not a party to the care contract between the family and the doula.
Doulas on the platform are independent contractors providing non-medical support services. Swaddl does not provide medical care, diagnosis, or treatment. Families with medical concerns should consult a licensed healthcare provider.
5. Fees and payments
Families pay the contracted fee for doula services upfront at contract signing. Swaddlthen submits a compliant claim to the family's employer benefit provider (Carrot Fertility, Maven Wallet, Progyny, or similar) for reimbursement, where applicable. Reimbursement decisions are made by the benefit provider and are subject to their terms and eligibility rules. We do not guarantee approval or reimbursement amount.
Doulas pay a monthly membership fee to access the platform and receive a share of each contract's value, as specified in their platform agreement.
Payment processing is handled by our third-party payment processor (Stripe). You agree to Stripe's terms of service in addition to these Terms.
6. Doula vetting and background checks
Every doula on Swaddl undergoes an application review, credential verification, reference checks, and a professional background check through a third-party provider (Checkr) before being approved to accept contracts. We reserve the right to decline or remove any doula from the platform at our sole discretion.
7. User conduct
You agree not to:
- Violate any applicable law or regulation
- Impersonate any person or misrepresent your identity, credentials, or affiliation
- Harass, abuse, or harm another user on or off the platform
- Attempt to circumvent the platform's fee structure by taking a matched engagement off-platform
- Access or attempt to access another user's account
- Scrape, copy, or systematically collect data from the platform without our express written permission
- Introduce malware or otherwise disrupt the Service
8. Intellectual property
The Service, including its design, text, graphics, logos, and code, is owned by Swaddl or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.
9. Termination
We may suspend or terminate your account at any time, with or without notice, if we believe you have violated these Terms or if we decide to discontinue the Service. You may terminate your account at any time by contacting us.
10. Disclaimers
The service is provided "as is" and "as available."
Swaddl makes no warranties, express or implied, regarding the Service, including warranties of merchantability, fitness for a particular purpose, non-infringement, or the accuracy of any information. We do not guarantee that a family will be matched with a suitable doula, that a benefit claim will be approved, or that the Service will be uninterrupted or error-free.
11. Limitation of liability
To the maximum extent permitted by law, Swaddl and its founders, employees, and agents shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to your use of the Service. Our total liability for any claim arising from these Terms or the Service shall not exceed the amount you paid Swaddl in the twelve months preceding the claim.
12. Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict of law principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in New York County, New York.
13. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated via email or through the platform. Your continued use of the Service after an update means you accept the revised Terms.
